Lets talk about what is copyright or trademark infringement?

Copyright is the act of protecting your work. This work can be anything like a song, writings, some piece of art, images, photographs, paintings, etc. A copyright holder is the one who owns the protection right of such a work. So when such things are copyrighted, they are being protected from being used by the others without taking the legal permission of the copyright holder.

When these copyrighted work or art is used without the permission of the copyright holder, it becomes copyright infringement. It is copyright infringement if such work is

  • Copied or reproduced
  • Used as a base to derive new work
  • Showcase it in public
  • Selling it

Let’s talk about this in terms of example. Katherine is an artist and creates amazing paintings with her own unique styles. She maintains a copyright for her pictures. Using her pictures without acknowledging her and taking her permission is a “copyright infringement”.

Trademark is close to copyright but is a totally different concept. A trademark is a phrase, word, symbol, logo or design that is associated with a particular product or company. It differentiates it from the other product, company or group.

We call it “trademark infringement” when the trademark of a company/group or product is used without permission. The infringement can also be in form of using a trademark closely identical to someone’s registered trademark.
